These Terms of Service (“Terms”) govern your access to the deckcam.com website and, where applicable, the DeckCam service, provided by DeckCam Inc., a Delaware corporation (“DeckCam”, “we”, “us”). By using our website or service you agree to these Terms.
The service
DeckCam is browser-based live production software that lets a venue run a multi-camera production from its own PTZ cameras. DeckCam is licensed per venue on a subscription basis. The specific features, camera support, limits and commercial terms that apply to your organization are set out in the order or service agreement you enter into with us.
Accounts & acceptable use
- You are responsible for keeping your account credentials secure and for activity that happens under your account.
- You agree to use DeckCam lawfully and only for content you have the right to capture, produce, stream and record.
- You agree not to misuse the service — for example by attempting to breach its security, reverse-engineer it, resell it without authorization, or use it to infringe others’ rights.
Subscriptions & billing
Paid plans are billed per venue on the cycle stated at sign-up or in your agreement. Unless your agreement says otherwise, subscriptions renew automatically for successive terms and fees are non-refundable except where required by law. We’ll give reasonable notice of material price changes.
Your content
You keep all rights to the video, audio and other content you produce with DeckCam. You grant us only the limited permission needed to operate the service for you. We don’t claim ownership of your productions.
Intellectual property
DeckCam, its software, and the deckcam.com website — including their design, text and branding — belong to DeckCam Inc. and are protected by intellectual-property laws. These Terms don’t transfer any of our rights to you except the right to use the service under your subscription.
Availability
We work to keep DeckCam reliable, and any uptime commitments are set out in your service agreement. Except as expressly stated there, the website and service are provided “as is” without warranties of any kind, to the fullest extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, DeckCam Inc. will not be liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of the website or service. Our total liability for any claim is limited to the amount you paid us for the service in the twelve months before the claim.
Termination
You may stop using the website at any time. Subscription cancellation is handled under your service agreement. We may suspend or end access if these Terms or that agreement are breached.
Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The courts located in Delaware will have jurisdiction over any dispute, unless your service agreement provides otherwise.
Changes
We may update these Terms from time to time. When we make material changes we’ll update the “last updated” date above and, where appropriate, notify customers. Continued use after a change means you accept the updated Terms.
